Every worker in South Africa is protected by labour laws. Whether you're starting your first job or have been working for years, here's what you need to know.

The Basic Conditions of Employment Act (BCEA)

This act sets minimum standards for:

  • Working hours: Maximum 45 hours per week (9 hours/day for a 5-day week, 8 hours/day for a 6-day week)
  • Overtime: Maximum 10 hours per week, paid at 1.5x your normal rate
  • Annual leave: 21 consecutive days per year (15 working days)
  • Sick leave: 30 days over a 3-year cycle (after 6 months of employment)
  • Family responsibility leave: 3 days per year for certain family emergencies
  • Maternity leave: 4 consecutive months (unpaid, but you can claim from UIF)

The Labour Relations Act (LRA)

This protects you against:

  • Unfair dismissal
  • Unfair labour practices
  • Discrimination in the workplace

You have the right to:

  • Join a trade union
  • Strike (following proper procedures)
  • Fair disciplinary processes
  • A written employment contract

The Employment Equity Act

Employers cannot discriminate based on race, gender, sex, pregnancy, marital status, family responsibility, ethnic or social origin, colour, sexual orientation, age, disability, religion, HIV status, conscience, belief, political opinion, culture, language, or birth.

What To Do If Your Rights Are Violated

  1. Raise the issue with your employer or HR department first
  2. Contact your trade union representative if you belong to one
  3. File a complaint with the CCMA (Commission for Conciliation, Mediation and Arbitration) — it's free
  4. Contact the Department of Employment and Labour
  5. Seek legal advice from a labour lawyer if needed
